End User License Agreement

This End User License Agreement ("EULA") is a legally binding agreement between you ("User," "you," or "your") and Cartha AI, Inc. ("Cartha AI," "we," "us," or "our") governing your use of the Cartha mobile application and related services (collectively, the "App"). By downloading, installing, accessing, or using the App, you agree to be bound by this EULA. If you do not agree to these terms, do not use the App.

1. License Grant

Subject to your compliance with this EULA, Cartha AI grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

2. Zero Tolerance Policy for Objectionable Content and Abusive Users

Cartha AI maintains a strict ZERO TOLERANCE policy for objectionable content and abusive behavior. This policy applies to all features of the App, including but not limited to video chat, messaging, and any other communication features.

2.1 Prohibited Content and Behavior

The following are strictly prohibited and will result in immediate action:

• Nudity and Sexual Content: Any display of nudity, sexual acts, sexually suggestive content, or pornographic material
• Harassment and Bullying: Targeting, intimidating, threatening, or humiliating other users
• Hate Speech: Content that promotes hatred, violence, or discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic
• Violence and Threats: Threats of violence, promotion of self-harm, or content depicting graphic violence
• Illegal Activities: Any content promoting or depicting illegal activities, including drug use, weapons trafficking, or exploitation
• Child Safety Violations: Any content involving minors in inappropriate contexts; we report such content to the National Center for Missing & Exploited Children (NCMEC) and law enforcement
• Spam and Scams: Solicitation, commercial advertising, phishing, or fraudulent schemes
• Impersonation: Pretending to be another person or misrepresenting your identity
• Recording Without Consent: Recording, screenshotting, or capturing video chat sessions without explicit consent from all participants

2.2 Enforcement and Consequences

Violations of this policy will result in immediate and permanent consequences:

• First Offense for Severe Violations: Immediate and permanent account termination with no warning
• Severe violations include: Nudity, sexual content, threats of violence, hate speech, child safety concerns, or any illegal activity
• No Appeals for Severe Violations: Accounts terminated for severe violations are not eligible for reinstatement
• Device Ban: We may ban your device from accessing the App
• Law Enforcement Reporting: Illegal activities will be reported to appropriate law enforcement authorities
• No Refunds: Terminated accounts forfeit any unused subscription time, credits, or virtual currency

2.3 Reporting Violations

If you encounter objectionable content or abusive behavior, you must report it immediately using the in-app reporting feature. You may also contact us at support@cartha.com. We investigate all reports and take appropriate action.

3. Video Chat Terms

The App includes features that allow you to connect with other users via video chat. By using video chat features, you agree to:

• Comply with all community guidelines and this EULA at all times
• Treat all users with respect and dignity
• Not record, stream, or capture video chat sessions without consent
• Use the skip, block, and report features to manage unwanted interactions
• Accept that Cartha AI does not screen or verify users and is not responsible for user conduct
• Exercise caution when sharing personal information with other users

4. User-Generated Content

You are solely responsible for all content you create, share, or transmit through the App. By using the App, you represent and warrant that your content does not violate this EULA, our Terms of Service, or any applicable laws.

5. Age Requirements

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this age requirement. We do not knowingly collect information from users under 18 and will terminate accounts of users we discover to be underage.

6. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any violation of this EULA. You may also delete your account at any time by contacting support@cartha.com.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. CARTHA AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARTHA AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP OR INTERACTIONS WITH OTHER USERS.

9. Indemnification

You agree to indemnify and hold harmless Cartha AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of this EULA.

10. Modifications to EULA

We may modify this EULA at any time by posting the revised terms in the App or on our website. Your continued use of the App after such modifications constitutes your acceptance of the updated EULA.

11. Governing Law

This EULA shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Santa Clara County, California.
